DHS to appeal US court on order blocking $100,000 H-1B fee

The Department of Homeland Security is urging an appeals court to reinstate a $100,000 H-1B visa fee, arguing a judge’s block harms immigration enforcement. The fee, intended to curb foreign worker replacement of Americans, was struck down by a judge citing separation of powers. DHS contends the President has authority for such measures, warning that delays allow more foreign workers entry, potentially causing irreparable damage.
