‘Rape is legal term, not medical’: HC says torn hymen no ground to doubt survivor’s testimony

The Allahabad High Court upheld a 1983 rape conviction, emphasizing that a survivor’s reliable testimony trumps medical findings about a hymen’s condition. Justice Santosh Rai stated rape is a legal, not medical, term, and a torn hymen doesn’t automatically grant an accused benefit of doubt. The court also corrected the original sentence, imposing a fine and directing the convicted man to surrender.
